Job Overview
Do you specialize in global privacy law? Are you looking to further develop your legal skills to help mitigate data protection and risk management issues? We are seeking someone with a strong privacy background (either law firm or in-house) to join our team as a Privacy Counsel, where you'll assist in driving the privacy and other regulatory affairs of the company. We are looking for someone with a thorough understanding of and experience working with key data protection, privacy, information security, communications, advertising, and marketing laws-including the EU General Data Protection Regulation (GDPR), EU Privacy and Electronic Communications Directive (ePrivacy Directive), California Consumer Privacy Act (CCPA), CAN-SPAM Act, and Telephone Consumer Protection Act (TCPA)-who will help us implement our compliance strategy and evolve it along with our business. As Privacy Counsel, you'll serve as an invaluable resource to both business leaders and the rest of our legal department, educating and partnering with them to build out the policies and procedures that will help us remain compliant with global privacy and data protection laws. Responsibilities
- Assist in developing and maintaining compliance programs and policies for iCIMS' privacy and data protection obligations, which include the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA).
- Negotiate, with appropriate escalation, complex global customer and vendor data processing agreements and addendums (DPAs), as well as, partner and other agreements.
- Work closely with the different areas of the business to provide legal advice on privacy matters and product designs.
- Assist in implementing updates to policies and processes for the business to address legal and privacy requirements, including data subject access requests, privacy impact assessments, records of processing activities,data analytics, artificial intelligence, and machine learning.
- Assist in driving data protection and privacy compliance through drafting, reviewing, updating, and helping to audit and enforce internal policies and procedures, as well as, conducting various compliance training workshops.
- Participate in conducting annual privacy and regulatory compliance risk management assessment and assist in driving compliance related corrective actions and remediation plans.
- Assist with litigation and dispute resolution matters, as necessary.
- Conduct research on a variety of privacy and data protection issues and act as an advisor to internal customers.
- Consistently ensure that business is conducted with integrity at all times and that behavior aligns with iCIMS policies, procedures, and values
Qualifications
- A minimum of 4 years of related legal experience at a law firm or government regulatory agency or in an in-house role.
- Experience with US, EU, and other global privacy and data protection laws required. Specific desired experience includes such privacy laws as the GDPR, ePrivacy Directive, CCPA, TCPA, and CAN-SPAM Act.
- Ability to work independently, while being a collaborative member of the team
- Ability to analyze case law and provide recommendations.
- Strong communication and interpersonal skills, with the ability to effectively build solid working relationships within various areas/business functions of the company, including management and senior executives.
- Strong customer orientation focus and success in creating a superior customer experience.
- Demonstrated success in displaying passion, drive, adaptability, and innovation.
- Demonstrated ability to solve practical problems or resolve issues in a timely manner.
- Extremely proficient in the MS Office Suite
Preferred
- At least 4 years post-qualification experience, including at a law firm or in-house (SaaS organization preferred), in relevant privacy/data protection laws and regulations.
- 5+ years of related experience is preferred.
- Additional education or certifications highly preferred but not required (e.g., CIPP/US, CIPP/E).
